Failure to Pay Wages, Overtime, Commissions

Our law firm represents employees, individually and on behalf of other similarly situated employees, who are not paid the wages they are due.  Typically, a single employee may not pursue a wage and hour lawsuit against her employer because the potential recovery of lost wages may not justify the costs and expenses of litigation.  However, when these similarly situated employees are represented in a class action setting where their individual claims are prosecuted collectively against a single employer, the class action mechanism now allows them challenge illegal labor and wage practices of their employers.

Our wage and hour cases typically arise when:

  1. Employees are misclassified as exempt from overtime
  2. Employees work “off-the-clock”
  3. Employer miscalculates the overtime pay rate
  4. Employer shares tips with employees
  5. Employer fails to pay for travelling time, on-call duty, and training
  6. Employer fails to pay the minimum wage
  7. Employer fails to provide meal and rest breaks
  8. Employer fails to provide duty-free meal and rest breaks
  9. Employer makes improper wage deductions or “charge backs”
  10. Employer fails to reimburse employees for business expenses or expenses necessarily incurred in the course of their job duties
  11. Employees are wrongfully classified as independent contractors.
